Jury selection is scheduled to begin in an Indiana woman’s trial this week. Toni McClure, 31, is accused of killing her 5-year-old daughter through starvation and confining her to a closet. Before the young girl’s death, McClure told police, “Kinsleigh told her that she wanted to die just prior to her death.”

Child Abuse Charges
McClure is charged with murder, criminal confinement resulting in bodily injury, and battery on a person less than 14 years old in connection with the death of her daughter, Kinsleigh Welty. She has pleaded not guilty to the charges and intends to play with fate before a jury of her peers.
Initial Discovery
On April 9, 2024, police responded to a home in Indianapolis, Indiana, to find a young girl severely malnourished and unconscious. Authorities identified the 5-year-old as Kinsleigh and said she was 38.5 inches tall, but weighed 21 pounds. Medical records reveal that she weighed more than that at only 2.5 years old.
Kinsleigh was described as having sunken eyes; she was extremely thin, with a bruise on her face and fecal matter matted in her hair and on the bottoms of her feet. Her hair was infested with lice, and other small insects were crawling on her body. She had unidentified bites and sores on the abdomen.
The Investigation
McClure told police Kinsleigh had spent time with her father that day, and after she picked her up, she said that her daughter had a headache and collapsed on the floor. However, Tammy Halsey, the child’s grandmother, gave officers a different narrative.
Halsey said that Kinsleigh’s father has not been in her life in over a year, and she became unconscious after falling in the bathtub and slipping below the water. Upon searching the home, officers quickly concluded that neither of their stories was the truth.
Officers entered McClure’s home to find a dresser blocking a closet door in what appeared to be her son’s room. Upon entering the closet, they found human fecal matter on the floor and walls, three empty protein-shake bottles, and a peanut butter sandwich.
Alleged Confession
McClure’s other children, her mother, and her boyfriend, Ryan Smith, told investigators that Kinsleigh spent most of her time locked in the closet and was only allowed out for short periods of the day. The defendant allegedly admitted to neglecting her daughter in a second interview with officials, and she knowingly continued the abuse.
She did not want to seek help because “she was scared to get into trouble” and wanted to keep her other kids in her custody. “Toni stated she was not going to lie, Kinsleigh told her that she wanted to die just prior to her death,” the arrest affidavit said.
“Toni believed Kinsleigh died because of malnourishment. Toni stated she did not know Kinsleigh had lice until she began the CPR. Toni stated she just assumed it was feces in her hair prior to the CPR.” She also allegedly admitted to locking her daughter in the closet “because she did not have to deal with her while she was in there.”
Child Neglect Accomplices
Case reports show text messages between McClure and her mother, which reveal they referred to the victim in a nasty format. They called her various names, “including but not limited to, ‘Evil,’ ‘Demon,’ ‘Dips—,’ ‘Dummy,’ ‘Chunkers,’ and ‘Heiffer.’
Police have also charged Halsey and Smith, who have both pleaded guilty to one count of neglect of a dependent resulting in death. As part of their plea agreement with the prosecution, they will only receive 20 years in prison if they testify truthfully at McClure’s trial.
